Terms of Service - Nordic Tennis Atelier

1. Introduction and acceptance of terms

These Terms of Service ("Terms") govern the use of services provided by Nordic Tennis Atelier ("we", "us", "our"), including all bookings, participation, purchases, and related interactions with our tennis services.

By booking, purchasing, attending, or otherwise using any service offered by Nordic Tennis Atelier, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

These Terms apply to all customers, participants, guardians, and other persons acting on behalf of a participant. Where a participant is a minor, the parent or legal guardian accepts these Terms on the minor's behalf and is responsible for ensuring compliance.

2. Scope of services

Nordic Tennis Atelier provides tennis-related services, including but not limited to:

• Privattræning
• Holdtræning for børn og voksne
• Teknik- og slaganalyse
• Turneringsforberedelse
• Ketcheropstrengning og udstyrsvejledning
• Tennis camps og weekendclinics

Service descriptions, schedules, locations, coaches, duration, and pricing may be published on our website, booking platform, social media, or communicated directly to customers. We reserve the right to modify service content, training format, venue, coach assignment, or timing where reasonably necessary.

Any advice regarding technique, equipment, training load, or competition preparation is provided for informational and sporting purposes only and does not constitute medical, physiotherapeutic, or nutritional advice.

3. User obligations and responsibilities

By using our services, you agree to:

• Provide accurate, complete, and up-to-date information when booking or communicating with us.
• Ensure that you or the participant are physically fit to participate in tennis activities.
• Inform us in advance of any relevant injuries, medical conditions, allergies, disabilities, or other circumstances that may affect safe participation.
• Follow all instructions given by coaches, staff, and facility personnel.
• Use appropriate sportswear and footwear suitable for tennis and the relevant venue.
• Treat coaches, staff, other participants, and facilities with respect.
• Refrain from abusive, disruptive, discriminatory, unsafe, or unlawful conduct.
• Take reasonable care of your own belongings; we are not responsible for loss or theft of personal items unless required by mandatory law.

You must not attend training or events while under the influence of alcohol, illegal drugs, or any substance that may impair safe participation.

If you are booking on behalf of a child or another person, you confirm that you have authority to do so and that the participant will comply with these Terms.

4. Payment terms and conditions

All fees, prices, and payment deadlines will be communicated at the time of booking or purchase unless otherwise stated. Unless expressly agreed otherwise, payment is due in advance.

• Prices may include or exclude applicable taxes depending on the stated offer.
• Bookings are only confirmed once payment has been received in full, where prepayment is required.
• Failure to pay on time may result in cancellation of the booking or suspension of access to services.
• We may use third-party payment providers. Their terms may also apply to the transaction.

If a payment is reversed, disputed, or charged back without valid reason, we may suspend services and recover any associated costs to the extent permitted by law.

For recurring packages, camps, clinics, or special events, separate payment terms may apply and will be disclosed before purchase.

5. Cancellation and refund policy

Cancellations and refunds are handled according to the type of service booked and any specific terms communicated at the time of booking.

• Private training: Cancellations made within the applicable notice period, if any, may be rescheduled or refunded at our discretion or as stated in the booking terms.
• Group training, camps, and clinics: Due to limited capacity and planning requirements, cancellations may be non-refundable or subject to partial refunds only if stated in advance.
• Equipment services: Stringing, equipment advice, and related services may be non-refundable once work has commenced, except where mandatory law requires otherwise.

If we cancel a service, we will, where reasonably possible, offer a rescheduled session, credit, or refund of the amount paid for the cancelled service. No refund will be due for missed sessions caused by the participant's failure to attend, unless otherwise agreed or required by law.

Refunds, where applicable, will normally be made using the original payment method within a reasonable period.

6. Liability limitations

Participation in tennis and related physical activities involves inherent risks, including but not limited to slips, falls, collisions, overuse injuries, equipment failure, weather-related hazards, and injuries caused by other participants or third parties.

To the maximum extent permitted by applicable law, Nordic Tennis Atelier shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profit, loss of opportunity, or loss of data.

Our liability for direct loss or damage arising from our services is limited to the extent permitted by mandatory law and, where lawful, to the amount paid for the specific service giving rise to the claim.

Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful, including liability for fraud, wilful misconduct, or gross negligence where such limitation is not permitted.

Participants are responsible for assessing their own physical condition and for seeking medical advice where appropriate before engaging in strenuous activity.

7. Intellectual property rights

All content provided by Nordic Tennis Atelier, including training materials, written materials, drills, videos, images, logos, branding, and other intellectual property, remains our property or the property of our licensors unless otherwise stated.

You may not copy, reproduce, distribute, modify, publish, transmit, or commercially exploit our materials without our prior written consent, except to the extent permitted by mandatory law.

If you submit photos, videos, testimonials, or other content to us, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content for legitimate business, marketing, and operational purposes, unless you withdraw consent where required by law.

8. Data protection and privacy

We process personal data in connection with bookings, payments, communication, training administration, safety, and service delivery. Personal data may include contact details, booking information, payment-related information, health-related information you choose to provide, and participation records.

We process personal data in accordance with applicable data protection laws and our privacy practices. Where required, we rely on appropriate legal bases such as contract performance, legal obligation, legitimate interests, or consent.

We may share personal data with service providers such as payment processors, booking platforms, IT providers, and venue operators where necessary for service delivery or legal compliance.

You have rights regarding your personal data, which may include access, rectification, deletion, restriction, objection, and data portability, subject to applicable law.

9. Force majeure

We shall not be liable for any delay or failure to perform our obligations if such delay or failure results from events beyond our reasonable control, including but not limited to extreme weather, fire, flood, epidemic, pandemic, strikes, power outages, transport disruptions, government restrictions, venue closure, war, terrorism, or failure of third-party systems.

In such circumstances, we may suspend, reschedule, modify, or cancel services as reasonably necessary. Where appropriate, we may offer alternative arrangements, credits, or refunds in accordance with the specific service terms and applicable law.

10. Changes to terms

We may update or amend these Terms from time to time to reflect changes in our services, operational needs, or applicable law.

The updated Terms will take effect when published or on a later date stated by us. Continued use of our services after the updated Terms take effect constitutes acceptance of the revised Terms.

If a change materially affects your rights or obligations, we may provide notice by email, website notice, booking platform notice, or other reasonable means.

11. Applicable law and jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws applicable in Denmark, subject to any mandatory consumer protection rules that may apply.

Any dispute arising out of or in connection with these Terms shall, to the extent permitted by law, be submitted to the competent courts in Denmark. If you are a consumer, you may also have the right to bring proceedings in your place of residence where mandatory law provides such right.

13. Severability clause

If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a competent court or authority, that provision shall be enforced to the maximum extent permitted and the remaining provisions shall remain in full force and effect.

Where necessary, the invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the original intent and commercial purpose of the original provision.
